Mr. Sacher Obtains Order from Complex Business Litigation Division Dismissing 12 Claims Against Clients in Action Seeking Damages of $150 Million
May 4, 2017 | Category: BLOG, News, Reported DecisionsFollowing briefing and extensive oral argument, Mr. Sacher secured an Order from the Miami-Dade County Circuit Court's Complex Business Litigation Division dismissing 12 of 14 claims asserted claims against his clients, a law firm and its principal. The case was brought by two foreign corporations seeking the return of approximately $150 million that was transferred by an authorized agent, who then used multiple law firms to disperse the funds:
- Aiding and Abetting claims
- Breach of Fiduciary Duty claims
- Constructive Trust claims
- Money Had and Received claims
- Negligence claims
- Accounting claims
The Court found that the Plaintiffs had met their initial pleading burden to sustain 2 claims for Unjust Enrichment, reducing the possible damages range from more than $150 Million to approximately $260,000.
Plaintiffs were given leave to amend their earlier pleading to attempt to assert sustainable claims.
